s <br />all plans and policies in force at the time the proposal <br />is made. <br />If all five criteria are met, the development order -may be <br />changed to allow additional slips to be released from the <br />"sailboat only" restrict to the extent consistent with the <br />approved Indian River County Manatee Protection Plan. Indian <br />River County, Treasure Coast Regional Planning Council and the <br />Florida Department of Community Affairs shall be furnished <br />with documentation of Department of Environmental Protection <br />and United States Fish and Wildlife Service favorable review. <br />In the absence of any one of the five criteria listed above, <br />any proposal for release of slips from the "sailboat only" <br />restriction shall be subject to substantial deviation review. <br />Development of docks in other locations (areas outside the <br />Marina) or development of boat ramps or dry storage facilities <br />shall be prohibited other than provision of recreational <br />access for project residents by non -motorized craft to the <br />internal estuarine/waterway system. Access shall be limited <br />to no more than two access points. No anchorage shall be <br />permitted. <br />5. Marina light -.ng shall be limited to low -intensity, low-level, <br />downward -directed types of lighting in order to minimize the <br />intrusion of light into adjacent estuarine areas. <br />6. The ±4.94 acre parcel described in Exhibit "A", attached, is <br />hereby.added to the project. <br />7. Resolution No. 93-88 of the Board of County Commissioners of <br />Indian River County is hereby amended by the correction of the <br />legal description of Parcel IX as shown on Exhibit "A" to <br />Resolution No. 93-88, such that the legal description for said <br />Parcel IX shall be: <br />All of.that portion of the Southwest 1/4 of the Southeast 1/4 <br />of Section 23, Township 32 South, -Range 39 East, lying East of <br />the said right-of-way line of Indian River Boulevard; said <br />lands lying and being in Indian River County, Florida. <br />The foregoing resolution was offered by Commissioner <br />Eggert and the motion was seconded by Commissioner <br />follows: <br />"dam , and, upon being put to a vote, the vote was as <br />Chairman John W. Tippin Aye <br />Vice Chairman Kenneth R. Macht Aye <br />Commissioner Fran Adams Aye <br />Commissioner Richard N. Bird Nay <br />Commissioner Carolyn K. Eggert.
