The Board reviewed the following memo dated 5/17/94: <br />TO: Board of Countvctrin� <br />y ommissioners <br />Q" P <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: May -17, 1994 <br />RE: Power Pole Siting Ordinance <br />The attached ordinance was* presented to the Board last year for <br />consideration and was approved in concept, but action was postponed <br />until a bill could be filed in the Florida Legislature. The bill passed <br />the Florida House but not the Senate. In December, 1993 the Board <br />directed this office to bring this ordinance back if the Legislature <br />failed to take action. <br />Since state law forbids the regulation of power pole "siting as a land <br />development regulation, this ordinance attempts to provide some <br />protection to the local homeowner by requiring public hearings for <br />siting transmission and distribution lines when other public hearings <br />are not required by Florida law. <br />This ordinance would apply to lines between 68 kilovolts and 230 <br />kilovolts. <br />Recommendation: Staff recommends approval. <br />The Chairman opened the Public Hearing, and asked if anyone <br />wished to be heard in this matter. <br />Rachel Scott of Florida Power & Light introduced senior <br />attorney Jean Howard, senior engineer Dan Collata, and Ralph <br />Edmundson, supervisor of transmission lines. <br />Jean Howard, senior attorney for FP&L, read aloud the <br />following letter of objection to the proposed ordinance: <br />57 <br />MAY 24 1994, MOO 92 Ae;.50 <br />
