It is a 1.14 acre parcel with 300 feet of -frontage on <br />Hedden Place, which appears to have been created as a result of <br />access easements, instead of public or private right-of-way <br />dedications. I believe, however, that Hedden Place has public <br />utilities in it. <br />The seller and real estate professional represented to my <br />client (Mr. Van Vorst) that the property could be divided into two <br />residential lots, and my client purchased it with that <br />understanding. He then built a house on the north one-half of the <br />property. He would like to convey the south one-half to his <br />sister, who is confined to a wheelchair. Bach of the resulting <br />lots would have more than 150 feet of frontage on Hedden Place, and <br />each would be greater than one-half acre in size (larger than the <br />average Hedden Place lot). <br />When I discussed this matter with Stan and John, we looked at <br />Section 913.06(1)(C), which prohibits dividing property where a <br />resulting lot has frontage on a dedicated public right-of-way, <br />private platted right-of-way, or roadway maintained by the county, <br />less than a specified number of feet. for access, <br />ingress and egress, or for other purposes are not considered <br />publicly dedicated road rights-of-way. <br />81 <br />MpY 24 494 <br />BOOK 92 PA -U-5206 <br />
