K. Request for Floodplain Cut and Fill Balance waiver for Oak <br />Point Subdivision <br />The Board reviewed the following memo dated 5/26/94. <br />TO: James Chandler <br />County Administrator <br />THROUGH: James W. Cox, P.E. b -- <br />Civil Engineer <br />SUBJECT: Request for Floodplain Cut and Fill Balance Waiver for Oak Point Subdivision <br />REFERENCE: 'SD-93-09-08/LDP Application No. 93040058-007 <br />DATE: May 26, 1994 CONSENT AGENDA <br />Knight, McGuire & Associates, Inc., on behalf of Sanctuary Park, Inc., the developers of Oak Point <br />Subdivision, is requesting a waiver of the cut and fill balance requirement of Section 930.07(2)(d) <br />of the Stormwater Management and Flood Protection Ordinance. Oak Point Subdivision received <br />preliminary plat approval from the Planning & Zoning Commission on January 13, 1994. The <br />project is located at the northwest corner of Indian River Boulevard and 37th Street adjacent to the <br />east property line of Medical Service Center Subdivision. The entire site is located in special flood <br />hazard area AE with a base flood elevation of 7.0 ft. N.G.V.D. and ten year flood elevation of 4.0 <br />ft. The existing ground elevations on the site range from 4.5 ft. to 2.5 ft. The proposed <br />displacement of the floodplain below 4.0 ft. for which the waiver is needed is approximately 10,000 <br />cubic yards. The displacement below the 7.0 ft. base flood elevation is estimated at 50,000 cubic <br />yards by the applicant's engineer in the attached letter dated March 22, 1994. <br />The project meets the cut and fill balance waiver criteria provided in Section 930.07(2)(d)1. of being <br />situated in an estuarine environment within the 100 year floodplain along the Indian River and in <br />staffs opinion it appears that all other Stormwater Management and Flood Protection Ordinance <br />requirements can be met without adverse impact on other lands in the estuarine environment. <br />A SJ.R.W.M.D. Management and Storage of Surface Waters Permit has been approved for the <br />project. An application for a Land Development Permit has been received by the Public Works <br />Department. <br />Alternative No. 1 <br />Approve the cut and fill balance waiver request. <br />Alternative No. 2 <br />Deny the waiver request and require re -design to accomplish an on-site balance of cut and fill_. <br />RECOINDATION <br />Staff recommends approval of Alternative No. 1. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board approved Oak <br />Points cut and fill balance waiver request. <br />JUN 7 1994 13 sof fAk 56 <br />I <br />
