Country Club property that is being developed in the Vero Beach <br />Highlands. <br />Commissioner Bird preferred that we agree to mitigate just the <br />property on the park site and not the 5.5 acres of the utility <br />site. We may have a need to drill wells or put something else in <br />there in the future, and we probably would have to go to U.S. Fish <br />and Wildlife for approval since it is habitat for an endangered <br />species. <br />Director Keating felt that would be the case. What we are <br />looking at is not establishing a specific easement, but delineating <br />these areas on a site plan. It is different than many other cases <br />where private entities actually give an easement to the benefit of <br />the County. The request here is not to give an easement to the <br />benefit of U.S. Fish and Wildlife Service, but just to denote these <br />on the site plan. We would go to U.S. Fish and Wildlife Service <br />and make sure the way it is proposed is compatible with the area. <br />We discussed this with them and we do not anticipate it being a <br />problem. <br />Commissioner Bird understood then that through the permitting <br />process, U.S. Fish and Wildlife would retain control over the <br />utility 5.5 acres whether or not we give it to them outright. That <br />being the case, he stated he would withdraw his second to <br />Commissioner Macht's motion to forego mitigation on both sites. <br />COMMISSIONER BIRD WITHDREW HIS SECOND TO <br />COMMISSIONER MACHT'S MOTION AND THE MOTION <br />DIED FOR LACK OF A SECOND. <br />MOTION WAS MADE by Commissioner Bird, SECONDED <br />by Commissioner Eggert that the Board agree to <br />mitigation on the park site only. <br />Under discussion, Attorney Vitunac stated that he understood <br />from Director Keating that to comply with the U.S. Fish & Wildlife <br />Service we need to set aside only 3 acres on the utilities site if <br />we were to drill a well there. However, our own County Codes are <br />more restrictive. <br />Commissioner Eggert understood then that Commissioner Bird's <br />motion is that we handle the Utilities site if and when it comes <br />up. <br />THE _CHAIRMAN CALLED FOR THE QUESTION.
