It is roughly 11 feet in excess of <br />what normally would be required for 2 -way traffic. They are <br />comfortable that the plan works with regard to the LDRs. <br />John Atz, engineer from Kimley-Horn, returned to the podium to <br />readdress the issue of Mooringline Drive being a major driveway. <br />Tom Vincent, vice president of Halvorsen Development, stated <br />they are here today as the agent of the property owner. Halvorsen <br />does have an interest here, and when you are talking about property <br />owners' rights and the rights to develop a piece of property, this <br />particular property owner's right is not any less important or less <br />significant than anyone else in this room or any other person that <br />has an objection to this project. He emphasized that this is not <br />a zoning hearing to consider the land use or related compatibility <br />issues. He felt that if consideration is given to all of the <br />testimony given today by the consultants and professionals, the <br />Board will find that they have in fact provided substantial, <br />competent evidence to satisfy each and every one of the <br />requirements in Section 914.15 of the LDRs. <br />Ron Ferrin, owner of the subject property, reiterated that <br />they have come before the Board today for approval of an <br />economically viable use of the land that they feel will enhance and <br />maintain the quality of life that has been established here in <br />Indian River County. <br />Attorney Ralph Evans closed his presentation by emphasizing <br />that the proposed site plan meets all requirements of the LDRs. He <br />asked the Board to vote favorably for site plan approval. <br />There being no others who wished to be heard, the Chairman <br />closed the public discussion. <br />At Chairman TippinIs request, Attorney Vitunac read aloud <br />Excerpt #4 from his memo of 7/6/94: <br />"The administrative procedure for site plan approval is <br />quasi-judicial in nature, and conducted to factually <br />determine if a proposed site plan submitted by the <br />property owner conforms to the specific requirements set <br />out in the administrative regulations governing the <br />erection of improvements on the property.
