On the other hand, if we deny it <br />and lose in court, then all the citizens of Indian River County <br />suffer the cost and resulting damages. <br />Attorney Vitunac advised that as far as defending a lawsuit, <br />the County would be in the safest position to grant site plan <br />approval. <br />Commissioner Eggert stated she has great respect for staff and <br />T believed staff knows that, but she has a real problem with access, <br />safety, and+ noise, especially when it comes to the road behind <br />Publix. For those reasons she would not support the motion. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The <br />motion to grant site plan approval to <br />Halvorsen Development passed by a vote of 4-1, <br />Commissioner Eggert dissenting. <br />119 <br />July 12, 1994 <br />
