Director Keating continued the presentation of all the <br />information that was provided to the P & Z Commission to support <br />the decision that grocery stores and supermarkets are the same use. <br />Staff's recommendation is that the Board first find that neither he <br />nor the P & Z Commission failed in any of the four areas for <br />review; and second, deny the appeal and uphold the P & Z <br />Commission's decision that grocery stores and supermarkets are the <br />same use within the context of the Zoning Code. <br />Chairman Tippin asked if the Board had any questions at this <br />point. There being none, he opened the public discussion. <br />Attorney Warren Dill, appearing on behalf of the concerned <br />residents of the Moorings, specifically Gene Winne, William <br />Lampert, Robert Salmon, Jr., John W. Zilg and George Millington, <br />commented on the great number of people in attendance this morning <br />considering that approximately 80 percent of the residents of the <br />Moorings and South Beach usually are up north at this time of the <br />year. <br />Attorney Dill listed the speakers who will be presenting <br />documents and giving testimony this morning: <br />Gene Winne -- overview of the use issue and size factor. <br />Warren Dill -- legal review of the criteria. <br />Prof. Ronald W. Cotterill -- discussion of Stanard Industrial <br />Classification (SIC) Code and explanation of staff's <br />incorrect conclusion. <br />Robert Swarthout -- planning issues required to be <br />considered by the Board, i.e. parking, adverse impacts, <br />property values, compatibility, etc. <br />Before beginning their presentation, Attorney Dill wished to <br />make sure that the record of this meeting contains everything that <br />was presented to the P & Z Commission and to the County Planning <br />staff prior to today's hearing. He pointed out that two items were <br />omitted from this hearing: 1) His initial letter requesting staff <br />to make this determination, and 2) The actual decision by John <br />McCoy, the designee of Community Development Director Robert <br />Keating, determining that supermarkets and grocery stores were <br />synonymous terms. <br />Attorney Dill also requested that the following items be made <br />part of this record: <br />Staff's memo of recommendation. <br />Minutes of the June 9, 1994 P & Z Commission meeting. <br />All the letters, petitions and correspondence sent to the <br />County Commission. <br />20 yg <br />BOOK S F'AU,F 79 <br />July 12, 1994 <br />
