JUL 19 199 <br />RESOLUTION NO. 94- 93 $o{)K 9 <br />b. present existing level of service with all analysis used <br />to determine the level of service; <br />C. determine traffic projections for each roadway link and <br />intersection for one year into the future including <br />background, discounting all new traffic from other <br />projects in Indian River County, plus project traffic; <br />d. specify improvements necessary to provide Level of <br />Service D for peak-hour/peak-season conditions on the <br />monitored roadway links and intersections; and <br />e. identify methods for funding the necessary roadway <br />expansions. <br />Commencing in the year 1997, no further building permits for <br />the Indian River Mall Development of Regional Impact shall be <br />issued after three months from the due date of the Annual <br />Report as established in the Development Order, until the <br />Traffic Monitoring Report referenced above has been submitted <br />to and approved by Indian River County and the City of Vero <br />Beach. <br />No further certificates of occupancy shall be issued for the <br />Indian River Mall Development of Regional Impact within a year <br />of the date of the Traffic Monitoring Report until roadway <br />expansions, if any, specified in the approved Traffic <br />Monitoring Report are under construction. Monitoring of the <br />roadway links may be discontinued once expansion of the <br />roadway link to a four -lane cross-section is under <br />construction or by buildout of the Indian River Mall. <br />49. Commencing in 1995 and continuing every year thereafter, the <br />developer shall submit an Annual Status Report indicating the <br />status (schedule) of guaranteed roadway expansions. This <br />Annual Status Report shall be submitted to Indian River <br />County, Florida Department of Transportation, Treasure Coast <br />Regional Planning Council and the Department of Community <br />Affairs as part of the Development of Regional Impact Annual <br />Report. <br />The Annual Status Report shall list all roadway expansions <br />needed to be constructed by phase, the guaranteed date of <br />completion for the construction of each needed expansion, the <br />party responsible for the guaranteed construction of each <br />expansion, and the form of the binding commitment that <br />guarantees construction of each expansion. <br />No further building permits for the Indian River Mall <br />Development of Regional Impact shall be issued at the time the <br />Annual Status Report reveals that any needed transportation <br />network expansion included in the Development Order is no <br />longer scheduled or guaranteed, or has been delayed in <br />schedule such that it is not guaranteed to be in place and <br />operational, or under actual construction for the entire <br />expansion by December 31, 1999. <br />50. A traffic methodology meeting shall be conducted for any <br />proposed change to the Development Order that may affect <br />traffic, such as an increase in project size and extension of <br />the project buildout dates. The Florida Department of <br />Transportation, the Department of Community Affairs, Treasure <br />Coast Regional Planning Council, Indian River County, and the <br />City of Vero Beach shall be present at the meeting. Issues to <br />be discussed at the meeting include, but are not limited to: <br />trip generation rates, trip distribution and assignment, <br />passer-by rates, growth factors, application of the growth <br />76 <br />
