r v r <br />ORDINANCE NO. 94-25 <br />(2) Variances. <br />of the provisions or tnis orainance snali De nearu ay <br />the Board of Zoning Adjustments pursuant to the <br />requirements of Chapter 902, Administrative <br />Mechanisms. The Board of Zoning Adjustments may also <br />hear and decide appeals when it is alleged there is an <br />error in any requirement, decision, or determination <br />made by the Community Development Director in <br />enforcement or administration of this ordinance. <br />Written findings shall be mailed to the FEMA Region IV <br />Office. Since the purpose of this ordinance is to <br />reduce future flood damages to lives and property, <br />aonroval of variances is limited by the following: <br />(a) Variances may be granted only for the following <br />situations: <br />1. substantial improvements to historic <br />buildings (see definition); <br />2. functionally dependent water related uses; <br />3. physical hardships pertaining to the <br />topography, soils, geology, or <br />configuration of a lot. <br />Jbi Variances for historic buildings shall be <br />subiect to the following determinations: <br />1. submittal of documentation from the State <br />Historic Preservation Office, or federally - <br />certified local historic preservation <br />review board, that: <br />M the structure is either on or <br />eligible for individual listing <br />ion the National Register of <br />Historic Places or a state <br />register of historic properties, <br />or is within or would be eligible <br />for listing as a primary, <br />secondary, or contributing <br />structure within a National <br />Register Historic District; <br />25 BOOK �a 153 <br />August 31, 1994 <br />
