RESOLUTION NO. 2018 — 038 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />AUTHORIZING THE FLORIDA DEPARTMENT OF <br />TRANSPORTATION TO ACQUIRE PROPERTY RIGHTS. <br />WHEREAS, Indian River County (COUNTY) is pursuing the construction of a roadway <br />project (Project) for County Road 609 (82nd Avenue/Ranch Road) from 69th Street to County <br />Road 510, as depicted in the attached Exhibit "A" and associated with Item / Segment Number <br />230879-2, Section 88503-2611, in Indian River County, Florida; and <br />WHEREAS, the Project will involve the acquisition of certain property rights along the <br />Project corridor, either through administrative settlements or eminent domain proceedings; and <br />WHEREAS, the COUNTY desires for the State of Florida Department of Transportation <br />(DEPARTMENT) to perform the right of way acquisition, for and on behalf of the COUNTY; and <br />WHEREAS, the COUNTY hereby authorizes the DEPARTMENT to conduct right of way <br />acquisition and related activities, including eminent, domain proceedings, on the Project, in <br />accordance with the federal Uniform Relocation Assistance and Real Property Acquisition Act of <br />f970, as amended; and <br />WHEREAS, upon the DEPARTMENT's completion of its acquisition activities, the <br />COUNTY will accept the acquired property from the DEPARTMENT; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br />Indian River County that, as part of the cooperative efforts between the DEPARTMENT and the <br />COUNTY, INDIAN RIVER COUNTY DOES HEREBY authorize the DEPARTMENT to <br />obtain all property rights needed for the Project, as stated above. <br />BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded <br />forthwith to the State of Florida Department of Transportation Right of Way Office at 3400 West <br />Commercial Boulevard, Fort Lauderdale, Florida 33309. <br />
