1/87(RESO)LEGAL(Vk <br />RESOLUTION NO. 87- 11 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING THE <br />SUPERVISOR OF ELECTIONS TO EXECUTE CERTIFICATES <br />HOLDING OWNERS OF PROPERTY USED BY THE COUNTY FOR <br />POLLING PLACES FOR COUNTY ELECTIONS HARMLESS FROM <br />ANY AND ALL CLAIMS FOR DAMAGES RELATING TO THE <br />COUNTY'S USE OF SUCH PLACE. <br />WHEREAS, Indian River County uses private property with <br />consent of the owner for many of its polling place sites in <br />conjunction with county elections; and <br />WHEREAS, as a condition of this use many owners have <br />requested that the County hold them harmless from any and <br />all claims for damages relating to the County's use of such <br />site; and <br />WHEREAS, giving such an assurance would be in the <br />public interest since without it there would not be adequate <br />and conveniently located polling places in our county; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS, that: <br />1. The Board ratifies the above statements; <br />2. The Board authorizes the Supervisor of Elections to <br />sign copies of this resolution for specific properties being <br />used by the Supervisor's Office in conjunction with the <br />holding of county elections which, once signed, shall <br />certify that the property is covered by the hold harmless <br />provisions of this resolution. <br />The foregoing resolution was offered by Commissioner <br />Eggert who moved its adoption.
