ARCH INSURANCE COMPANY <br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY. <br />NON -MONETARY CLAIMS <br />This endorsement modifies the insurance provided under the following: <br />COMMERCIAL GENERAL LIABILITY COVERAGE FORM <br />In the event of a "claim" or "suit" seeking non -monetary relief or remedial action, but not seeking monetary damages, <br />or a "claim" or "suit" involving the Fair Labor Standards Act, we will pay up to $100,000 reimbursement to the insured <br />for reasonable legal expenses incurred by the insured in defending such "claim" or "suit." We will only pay such <br />expenses if the "claim" or "suit" is based upon, arising out of, or attributable to a "wrongful act" for which coverage is <br />not otherwise excluded under this Coverage Part. Any exclusion relating to the Fair Labor Standards Act does not <br />apply to the coverage provided by this endorsement. <br />Reimbursable legal expenses are limited to: <br />(1) fees or expenses paid by the insured to an attorney or law firm; <br />(2) fees or expenses paid by the insured to the court having jurisdiction over such "claim" or "suit"; <br />(3) fees or expenses paid by the insured to witnesses that testify on the insured's behalf except for any witness <br />who is an insured; and <br />(4) the cost of any required court bonds paid by the insured, but we do not have to furnish these bonds. <br />In the event of multiple "claims" or "suits", all of which pertain to the same "wrongful act," or pertain to a series of <br />related "wrongful acts", $100,000 is the most we will reimburse the insured for all covered legal expenses arising out <br />..4.
