in this Development Order shall be interrupted, hindered,
<br />delayed or prevented by reason of strikes, lockouts or
<br />labor troubles; inability to procure construction
<br />materials due to general shortage, government rationing
<br />or regulation of labor, materials, equipment, facilities
<br />or sources of energy (including, without limitation,
<br />electricity, oil or gas); failure of power or
<br />transportation; riots, mob violence, sabotage, malicious
<br />mischief, insurrection, civil commotion or war; Acts of
<br />God fire earth•uake flood hurricane, explosion,
<br />natural disaster or other casualty or other reasons of a
<br />similar nature beyond the reasonable control of the
<br />Developer or the County, as applicable, in performing
<br />work or doing acts specified under the terms of this
<br />Development Order, then, and in each such event,
<br />Developer or County, as applicable, shall be excused from
<br />such performance or act for the period of delay
<br />(including the period of both the actual delay and any
<br />consequential delays resulting therefrom) and any period
<br />set forth in the conditions of this Development Order in
<br />performance of any such work or act shall be extended for
<br />a period equivalent to the period of such delay
<br />(including the period of both the actual delay and any
<br />consequential delays resulting therefrom).
<br />40. Prior to site plan release, the developer shall dedicate to
<br />the county and the Indian River Farms Water Control District
<br />a 30' wide access easement for canal maintenance purposes.
<br />Said easement shall run the length of the Lateral "A" Canal
<br />from SR 60 to 26th Street. The easement will allow possible
<br />future maintenance of the canal from the canal's east side,
<br />rather than from the canal's 66th Avenue side. Such a shift
<br />in maintenance sides is intended to maximize the ability of
<br />the county to use canal right-of-way along 66th Avenue for
<br />road purposes which could help minimize the amount of 66th
<br />Avenue future expansion westbound, toward the Vista Plantation
<br />golf course.
