McCoy, AICP ,,� M <br />Senior Planner, Current Development <br />DATE: September 29, 1994 <br />SUBJECT: Sandpointe West Development L.C.'s Request for Plat <br />Vacation for a Portion of Sandpointe West Subdivision <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 11, 1994. <br />DESCRIPTION AND CONDITIONS: <br />Sandpointe West Development L.C. is requesting that the Board of <br />County Commissioners vacate a portion of the Sandpointe West <br />subdivision as recorded in plat book 13, pages 31 and 31A of the <br />Public Records of Indian River County, Florida. The portion of the <br />plat to be vacated includes Lots 1-12 and the east } of Lot 13 (see <br />attachment 3), all of which are owned by Sandpointe West <br />Development L.C. It should be noted that no rights-of-way will -be <br />vacated with this plat vacation. Thus, only the actual lots will <br />be vacated, and returned to unplatted acreage. The subject <br />property is located on the south side of Sandpointe West Lane, and <br />north of and adjacent to the St. Edward's Upper School campus. <br />The portion of the plat to be vacated does not affect public or <br />private facilities, or access rights other than those associated <br />with the lots being vacated. The applicant has tentatively agreed <br />to a land swap with St. Edward's Upper School, whereby the portion <br />of land to be vacated would be transferred to St. Edward's Upper <br />School and a portion of the St. Edward's river frontage would be <br />transferred to the developer for future subdivision development as <br />an addition to Sandpointe West. It should be noted that the <br />developer has already obtained preliminary plat approval for this <br />subdivision addition. The remaining } lot, which will not be part <br />of the plat vacation, will be retained by the developer as an <br />"unbuildable" tract that will later be replatted as a right-of-way <br />to access the proposed addition to Sandpointe West. The land swap <br />arrangement was described and reported on during the special <br />exception use hearings conducted April 26, 1994 for expansion of <br />the St. Edward's facility onto the subject property. According to <br />the applicant, the plat vacation will make the land swap a <br />"cleaner" transaction.
