SAMPLE AGREEMENT <br />THIS AGREEMENT is by and between INDIAN RIVER COUNTY, a Political Subdivision of the State of Florida <br />organized and existing under the Laws of the State of Florida, (hereinafter called OWNER) and Johnson - <br />Davis, Inc. (hereinafter called CONTRACTOR). OWNER and CONTRACTOR, in consideration of the mutual <br />covenants hereinafter set forth, agree as follows: <br />ARTICLE 1- WORK <br />CONTRACTOR shall complete all Work as specified or indicated in the Contract Documents. The Work is <br />generally described as follows: <br />The proposed work generally consists of furnishing all labor, materials, tools and equipment required <br />to remove and replace an existing air release valve (ARV), a portion of a 24" diameter force main, and <br />associated appurtenances in Indian River County. The site is located along the west side of US Highway <br />1 approximately 400 feet south of Schumann Drive. The project will consist of the installation of <br />ductile -iron pipe restraints; the installation of wet taps; the installation of a temporary by-pass <br />forcemain; the installation of line stops; the removal and replacement of an existing ARV and related <br />concrete manhole structure; the removal of a segment of ductile iron forcemain and its replacement <br />with a PVC forcemain, and removal of the temporary by-pass forcemain. <br />ARTICLE 2 - THE PROJECT <br />The Project for which the Work under the Contract Documents may be the whole or only a part is <br />generally described as follows: <br />Project Name: <br />Bid Number: <br />Project Address: <br />ARTICLE 3 - CONTRACT TIMES <br />3.01 Time of the Essence <br />US 1- Air Release Valve and 24" Forcemain Replacement <br />2018047 <br />10595 US Highway 1, Sebastian, FL 32958 <br />A. All time limits for Milestones, if any, Substantial Completion, and completion and readiness for <br />final payment as stated in the specifications are of the essence of the Agreement. <br />3.02 Days to Achieve Substantial Completion, Final Completion and Final Payment <br />A.
