the property. On February 2, 2016, David Ash purchased the property from Ralph <br />Santoro. On February 24, 2016, and February 25, 2016, the Department conducted <br />a site investigation of the property. During the referenced site investigations, the <br />Health Department identified untreated septic spoil materials typically associated <br />with drainfield repairs (drainfield rock, pipes, etc.). It is clear from the condition of the <br />property and from historical aerial photographs that illegal dumping has been taking <br />place on the property and that the dumping began at some point after 2005. There is <br />surface water along two of the four sides of the property. Untreated septic spoil <br />materials were discovered within 5 to 15 feet of the surface water in violation of <br />Florida rules that require a setback of at least 200 feet from surface waters. The <br />Hearing Board Office notified all Indian River County's licensed septic contractors <br />that is was not permissible to use septic spoil materials as fill unless it was lime <br />stabilized. The Hearing Board Office also met one on one with several licensed <br />septic contractors allegedly using the property. The Florida Fish and Wildlife <br />Conservation Commission enforcement staff also met with Office staff about this <br />case. The current property owner, David Ash, agreed to restrict access to the <br />property and set up a camera to monitor those trying to access the property. David <br />Ash also agreed not to develop the property for at least one year to allow for <br />stabilization of the septic spoil materials. <br />14.
