16. The conditions on the Subject Property constitute the creation and maintenance of <br />a condition capable of breeding flies, mosquitoes, or other arthropods capable of transmitting <br />diseases. directly or indirectly to humans in violation of Section 386.041(e), Florida Statutes. <br />17. DOH also observed a washing machine connected to Structure I) that discharges <br />wastewater directly onto the open ground. Please see "exhibit 1. photo 8A." This discharge of <br />wastewater constitutes sanitary nuisances that are a violation of Sections 386.041( ])(a), and (e) of <br />F.S. <br />18. Additionally, there is a large pile of solid waste and unmaintained overgrown <br />vegetation throughout the underlying property. Please see "exhibit 2, photo 9" and "exhibit 2, photo <br />10." This has (1) created conditions for rodent and roach harborage, (2) created, maintained or <br />caused a condition capable of breeding flies, mosquitoes, or other arthropods capable oftransmitting <br />diseases, directly or indirectly to humans, and (3) created a condition that is harmful to human and <br />animal life, and can causes the release of air pollutants, gases, and noisome odors which are harmful <br />to human and animal life. The referenced pile of solid waste and overgrown vegetation is a nuisance <br />that can be injurious to the healthof humans and violate Sections 386.041(1)(a), and (e). and (f), <br />Florida Statutes. <br />19. On February 8, 2018, DOH sent a Notice of Violation to the listed owners of the <br />Subject Property via certified mail. DOH also placed a copy of the Notice of Violation at the primary <br />residence ofthe owners located at 3810 451" Street, Vero Beach, FL 32967. Please see "exhibit 5." <br />20. Subsequently, DOH discovered that the owners were both deceased. <br />21. On February 14, the service of processor left a notice at the Subject Property and the <br />Notice of Violation was returned to DOH. Please see .'exhibit 6-." <br />5 <br />146 <br />
