32. The use of an injunction is necessary to abate the ongoing sanitary nuisances because <br />there is no adequate remedy of law. Both of the owners, Dallas Yates and Jane Yates, are deceased, <br />and neither estate has been probated. Also, the registered agent for the Yates Group, LLC, has <br />indicated that it is too expensive to fix the safety and sanitary nuisances on the Subject Property. <br />33. It would serve the interests of the public as well as prevent irreparable injury to the <br />tenants, visitors, and/or general public if this Court entered an injunction to: (1) require the Yates <br />Group, LI_C, to hire a certified septic tank contractor or licensed plumber to abandon all of the <br />existing septic tanks on the Subject Property; (2) prohibit the Subject Property from being occupied <br />while there continues to be a sanitary nuisance; (3) prohibit the Subject Property from being <br />occupied until new septic tank systems are installed: and (4) require the Yates Group, LLC, or a <br />subcontractor, to clean all of the waste piles and vegetation from the Subject Property. <br />WHEREFORE, Plaintiff, INDIAN RIVER COUNTY, FLORIDA, respectfully requests that <br />this Court: <br />A. Enter a temporary or permanent injunction directing the Yates Group, LLC, the <br />Estate of Dallas Yates and/or the Estate of Jane Yates to abandon the existing septic <br />tanks on the Subject Property. <br />B. Enter a temporary or permanent injunction to enjoin the Subject Property from being <br />occupied while there are exposed sanitary and safety nuisances related to open septic <br />tanks. <br />C. Enter a temporary or permanent injunction to enjoin the Subject Property ftom being <br />occupied until new septic tanks and draintields are installed by a certified septic <br />contractor to service the existing structures. <br />8 <br />149 <br />
