This notice is given pursuant to the authority of the <br />Indian River County Environmental Control Act, Chapter 85-427, Laws of Florida. <br />BACKGROUND: The listed owners of this property (Dallas and Jane Yates) are deceased. Dallastine <br />Yates is currently collecting rent from the tenants of this property. There are 4 structures on the subject <br />property under the single legal address 8835 641h Avenue, Sebastian Florida 32967( Parcel ID: <br />3139290000050000047.0). The southernmost structure is a church,Structure A. Adjacent to the north <br />of Structure A is a single-family residence, Structure B. Adjacent to the north of Stucture B is a duplex, <br />Structure C. Adjacent to the north of Structure C is a second Duplex, Structure D. <br />The following violations exist on the property you own located at the subject property, observed by <br />representatives of this department on February 7, 2018: <br />VIOLATION 1: There are structures on the subject property that are being serviced by septic tank <br />systems that have been altered, modified, and damaged which is a violation of Section 64E-6.003 <br />Florida Administrative Code (F.A.C.), which states, "No portion of an onsite sewage treatment and <br />disposal system shall be installed, repaired, altered, modified, abandoned or replaced until a <br />construction permit has been issued on Form DH 4016". There are septic tanks that are not watertight, <br />that have partial lids, no lids, and structural damage that allows sewage to be discharged onto the open <br />ground.
