AMERICAN LAND TITLE ASSOCIATION COMMITMENT FOR TITLE INSURANCE WITH FLORIDA <br />MODIFICATIONS <br />SCHEDULE B PART I <br />ISSUED BY <br />STEWART TITLE GUARANTY COMPANY <br />Requirements <br />Corporations, a recorded certified Statement of Authority certified by the Florida Secretary of State is to be <br />recorded in official records of the county where the property lies. <br />D. If a certified Statement of Authority, which is less than 5 years old is recorded in official records in the county <br />where the property lies, you may rely upon it to establish the authority and identity of the party(ies) to execute the <br />deed to be insured. Determination must be made that the Statement of Authority has not been cancelled, limited <br />by a subsequent Statement of Authority or a statement of disassociation by the named member or manager (such <br />as being a debtor in bankruptcy. <br />E. If a power of attorney is to be used to convey the property on behalf of the limited liability company, absent a <br />recorded certified statement of authority, review the articles of organization and the operating agreement to <br />confirm the delegation of authority is permitted. <br />10. Record the Release of the insured property from the Mortgage recorded 07/23/2001, in Official Records Book <br />1417, Page 1185, of the Public Records of Indian River County, Florida, in the original principal amount of <br />$150,000.00 from Spanky Investments LLC to Harbor Federal Savings Bank. <br />11. Affidavit from the current owner stating there are no open mortgages that would affect the subject property. The <br />company reserves the right to make such additional requirements as it may deem necessary. <br />12.
