Mason Blake, Esquire <br />DEAN MEAD <br />7380 Murrell Road, Suite 200 <br />Melbourne, Florida 32940 <br />(321) 259-8900 <br />VEGETATIVE BUFFER EASEMENT <br />THIS VEGETATIVE P.UFFER EASEMENT (hereinafter referred to as the <br />"Agreement") is made the ay of2018, by FLORIDA INSTITUTE OF <br />TECHNOLOGY, INC., a Florida corpora ' n not for profit (hereinafter referred to as <br />"Grantor"), to INDIAN RIVER COUNTY, a political subdivision of the State of Florida <br />(hereinafter referred to as "Grantee"). <br />WITNESSETH: <br />WHEREAS, Grantor is the owner of that certain real property located in Indian River <br />County, Florida, as more particularly described in Schedule "A", attached hereto and <br />incorporated herein by reference (hereinafter referred to as the "Florida Tech Property"); <br />WHEREAS, Grantee is the owner of that certain real property adjacent to the Florida <br />Tech Property and located in Indian River County, Florida, as more particularly described in <br />Schedule "B", attached hereto and incorporated herein by reference (hereinafter referred to as the <br />"County Property"); and <br />WHEREAS, Grantor has agreed to grant to Grantee a vegetative buffer easement over <br />that portion of the Florida Tech Property more particularly described in Schedule "C", attached <br />hereto and incorporated herein by reference (hereinafter referred to as the "Vegetative Buffer <br />Area"), on the terms and conditions hereinafter set forth. <br />NOW, THEREFORE, for and in consideration of the premises, the sum of Ten <br />and No/ 100 Dollars ($10.00) and other good and valuable consideration, the receipt and <br />sufficiency of which are hereby acknowledged, the parties hereto do hereby covenant and agree <br />as follows: <br />1. Vegetative Butler Easement. Grantor does hereby grant, convey and confirm to <br />Grantee a vegetative buffer easement in perpetuity over the Vegetative Buffer Area of the nature <br />and character and to the extent hereinafter set forth (the "Vegetative Buffer Easement").
