Matin AIC <br />THROUGH: Sasan Rohani, AICD <br />Chief, Long - Rang Planning <br />FROM: John Wachte <br />Senior Planner, Long -Range Planning <br />DATE: October 19, 1994 <br />RE: Request to Amend the Comprehensive Plan to Create a New. <br />RC, Regional Commercial, Land Use Designation and -to <br />Redesignate Approximately 130.3 Acres from M-1 to RC; <br />PLAN AMENDMENT NUMBER: LURA 94-10-0064 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of October 25, 1994. <br />DESCRIPTION AND CONDITIONS <br />This is a county initiated request to amend the Future Land Use <br />Element of the Comprehensive Plan. The proposed amendments involve <br />changes to the Future Land Use Map and to the text of the Future <br />Land Use Element. The text changes will create a new RC, Regional <br />Commercial, land use designation, while the map changes will <br />redesignate 130.3 acres of land to the new RC. land use. designation. <br />These proposed amendments will implement a Stipulated Settlement <br />Agreement which the Board approved on October 18, 1994. That <br />Stipulated Settlement Agreement was the result of negotiations <br />between Indian River County and the State Department of Community <br />Affairs (DCA) to resolve the issues identified in DCA's Statement <br />of Intent to find the Indian River Mall Comprehensive Plan <br />Amendment not in compliance. <br />While the comprehensive plan amendment process typically requires <br />both Planning and Zoning Commission and Transmittal Public Hearings <br />prior to the Final Adoption Public Hearing, amendments associated <br />with settlement agreements are subject to different requirements. <br />Because the subject amendments are remedial amendments that are <br />associated with a Stipulated Settlement Agreement, state law allows <br />the Board to proceed directly to the Final Adoption Public Hearing. <br />The proposed additions and deletions to the text of the <br />comprehensive plan are shown on Attachment 4. In this attachment, <br />deletions are indicated by strike throughs, while additions are <br />.shown as underlined. <br />Background <br />On January 17, 1994s Ty Tarby, Trustee for the subject property, <br />submitted_ a request to amend_ -_the Future -Land Use Map of the <br />comprehensive plan and rezone approximately 130.3 acres located on <br />the north side of -S.R. -60-between 58th Avenue and 66th Avenue. <br />That request involved changing the subject property's land use <br />designation from M-1, Medium -Density Residential -1 (up to 8 units/ <br />acre) to C/I, Commercial/Industrial Node. <br />35 BOOK 9 .
