<br />13.04 Uncovering Work
<br />A. If any Work iscovered contrary to the written
<br />request ofENGINEER, it must, if requested bvENGI-
<br />NEER. be uncovered for ENG|NEER.s observation
<br />and replaced et C(]NTRA[TOFyoexpanms.
<br />B. If ENGINEER considers it necessary or
<br />advisable that covered Work be observed by ENGI-
<br />NEER or inspected or tested by others, CONTRAC-
<br />TOR, at ENGINEER's request, shall uncover, expose,
<br />ONTRAC'TOR.sdENG|NEER'orequeet.ahaUuncove[empone.
<br />or otherwise make available for observation, inspeo-
<br />bon, or testing as ENGINEER may nsquina, that
<br />portion of the Work in quootion, furnishing all neces-
<br />sary labor, material, and equipment |fitkafound that
<br />such Work is defective, CONTRACTOR shall pay all
<br />Claims, costs, losses, and damages (including but not
<br />limited boall fees and charges ofengineers, architects,
<br />ottorneyn, and other professionals and all court or
<br />arbitnafionorother dispute resolution costs) arising out
<br />of or relating to such uncovehng, exposure, observa-
<br />tion, 'inspeoUon, and testing,and of satisfactory
<br />replacement or naconnbooUon (including but not
<br />limited toall costs ofrepair orreplacement ofwork of
<br />others); OWNERanOWNERshall be entitled ba an
<br />'.
<br />appropriate decrease in the Contract Price. If the
<br />parties are unable toagree ashothe amount thereof,
<br />OWNER may make a Claim therefor asprovided in
<br />paragraph 10.05. If, hovmavm|. such Work is not found

<br />increase in the Contract Price or an extension of the

<br />reconstruction. 1fthe parries are unable to agree as to

<br />NEER. remove it from the Project and replace it with
<br />Work that ianot defective. CONTRACTOR shall pay
<br />all Claims, costs, |oaaes, and damages (including but
<br />not limited to all fees and charges of angineans,
<br />architeots, attonneya, and other professionals and all
<br />court orarbitration or other dispute resolution costs)
<br />arising out oforrelating tosuch correction orremoval
<br />(including but not limited to all costs of repair or
<br />replacement ofwork ofothers).
