DeBlois, AICP <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Buck <br />Code Enforcement Officer <br />DATE: 7/2/2018 <br />RE: Elite Trust & Escrow Company LLC's Request for Release of Easements at 2070 94th <br />Court, 2065 94th Avenue, and 2075 94th Avenue (Vero Tropical Gardens Unit 1) <br />It is requested that the Board of County Commissioners formally consider the following information at its <br />regular meeting of July 17, 2018. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by Elite Trust & Escrow Company LLC, owner of four adjacent lots at <br />2070 94th Court, 2065 94th Avenue and 2075 94th Avenue in Vero Tropical Gardens Subdivision Unit 1, <br />for release of common rear yard 10 foot drainage and utility easements on the lots. The purpose of the <br />easements release request is to allow for construction of a stormwater pond on the lots in conjunction with <br />site development of an adjacent commercial parcel (see attached maps). <br />ANALYSIS <br />The request has been reviewed by AT&T; Florida Power & Light Corporation; Comcast Cable Services; <br />the Indian River County Utilities Department; the County Road & Bridge and Engineering Divisions; and <br />the County Surveyor. None of the utility providers or reviewing agencies expressed an objection to the <br />requested release of easements. Therefore,.it is..staff s position that the requested easements release would <br />have no adverse impact to drainage or to utilities being supplied to the subject property or to other <br />properties. <br />RECOMMENDATION <br />Staff recommends that the Board, through adoption of the attached resolution, approve release of the <br />common rear yard drainage and utility easements described in the resolution. <br />ATTACHMENTS <br />Map(s) depicting easement proposed for release. <br />Proposed County Resolution Releasing Easement. <br />ease.bccmemo proj./appl. no. 2018040186/81738 <br />98 <br />
