DeBraal, Deputy County Attorney <br />DATE: July 10, 2018 Y <br />SUBJECT: Request for Temporary Construction Easement to Datapath Tower, LLC for former <br />Emergency Services Tower, <br />On June 19, 2018, the Board approved a Utility Equipment and Landscape Easement, a Special <br />Warranty Deed, a New Access and Parking/Turnaround Easement and a Utility Easement for <br />Datapath Tower, LLC, (Datapath) at the former Emergency Services tower next to the old jail <br />property at 1725 17th Street. The tower site was surplused and sold to Datapath in 2016. Datapath <br />has applied to the City of Vero Beach to construct a new monopole tower on the site and the City <br />requested the above documents as part of the site plan approval for the new tower. <br />The City has made an additional request for a temporary construction easement around the site for <br />the duration.of the construction of the tower. The easement will be used for storage of materials, <br />machinery, equipment and vehicles during construction of the tower. Datapath seeks a space of <br />about 65'X 75" or 4875 sq. feet around the tower. The easement will be needed for approximately <br />90 days. Staff has no objection to the request. The proposed temporary construction easement and <br />aerial photo showing the area of the easement is attached as Exhibit "A". Prior to the termination <br />of this easement, Datapath will return the TCE to its current condition. <br />Funding: There is no expenditure of County funds for this matter. Datapath will pay for the cost of <br />recording the easement. <br />Recommendation: Staff recommends that the Board approve the temporary construction easement <br />to Datapath Towers, LLC and authorize the Chairman to execute the easement on behalf of the <br />Board. <br />Copes to: Datapath Tower <br />Attachment: Temporary Construction Easement <br />83 <br />
