1 w A \ ate' '�-; vim►���r b�r�;�n {.e. <br />Section 302.051. - Cruelty to animals. <br />(A) Pursuant to F.S. § 828.12, as may be amended from time to time, cruelty to animals is a criminal <br />offense_ The animal control division shall investigate reported incidents involving cruelty to animals <br />and support investigations by other law enforcement agencies when so requested and refer cases <br />where probable cause exists to the state attomey's office for criminal prosecution. <br />(B) The following are cruelty to animal violations under this chapter, and, pursuant to F.S. § 828.27(6), <br />as may be amended from time to time, require mandatory court appearances, as set forth on the <br />citation issued for the violation(s), for any person: . <br />(1) To impound or confine any animal in any place or place of protection from the elements without <br />water at all times and sufficient food daily except under veterinary supervision; to keep any <br />animal in any insufficient protection from the elements to fail to provide protection from the <br />elements, dean quarters, and medical attention for sickly, diseased, or injured animals; or to <br />abandon any animal. However, this chapter shall not require the provision of protection from the <br />elements and clean quarters for livestock in open pasture. <br />(2) To leave or deposit any poison or any substance containing poison, in any common street, <br />alley, lane, or road of any kind, or in any yard or enclosure other than the yard or enclosure <br />occupied or owned by such person. <br />(C) The following are cruelty to animal violations under this chapter that do not require mandatory court <br />appearances, except as otherwise set forth herein, for any person: <br />(1) To injure any domestic animal by any means and fail to notify the owner of such animal, or, if <br />the owner cannot be notified, then notice shall be given either to an officer or the county 911 <br />system. <br />(2) <br />To tease or molest an animal. <br />(3) <br />As an operator of a motor vehicle, to allow an animal to occupy any unenclosed section of that <br />vehicle without restraining and securing the animal in a manner Which does '.not present a <br />danger to the animal or to others. <br />(4) <br />As an operator of a motor vehicle, to place or confine an animal or allow the animal to be <br />placed, confined, or remain in an unattended motor vehicle without sufficient ventilation or under <br />conditions for such a ,period of time as may reasonably be expected to endanger the health or <br />well being of such animal due to heat, lack of water, or such other circumstances as may <br />reasonably be expected to be cruelty or otherwise cause suffering, disability or death.
