RESOLUTION NO. 95- 91 CLERK CIRCUIT COURT <br />INDIAN RIVER <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, <br />AMENDING RESOLUTION 87-14 WHICH GRANTED TO THE <br />CITY OF VERO BEACH A WASTEWATER FRANCHISE IN <br />CERTAIN UNINCORPORATED AREAS OF INDIAN RIVER <br />COUNTY, FLORIDA; CONFIRMING THE RIGHT OF THE <br />CITY OF VERO BEACH TO OPERATE A RECLAIMED <br />WATER SYSTEM AS PART OF ITS WASTEWATER <br />FRANCHISE; CONFIRMING AND AUTHORIZING THE USE <br />OF STATUTORY SPECIAL ASSESSMENT POWERS TO <br />FINANCE THE CAPITAL COSTS OF A RECLAIMED WATER <br />DISTRIBUTION SYSTEM WITHIN THE FRANCHISE AREA; <br />AND PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, Indian River County adopted Resolution 87-14 granting <br />to the City of Vero Beach, its successors or assigns, the sole and <br />exclusive right, privilege or franchise to construct, maintain, and <br />operate a public wastewater system in certain unincorporated areas <br />of Indian River County; and <br />WHEREAS, the City of Vero Beach has relied on this franchise <br />agreement in constructing, maintaining, and operating public <br />wastewater systems in certain unincorporated areas of Indian River <br />County; and <br />WHEREAS, the City of Vero Beach has elected to enter into a <br />reclaimed water program as a method for the disposal of wastewater <br />effluent; and <br />WHEREAS, the original franchise agreement set forth in <br />Resolution 87-14 does not specifically provide a definition of <br />wastewater to include reclaimed water as a wastewater disposal <br />technique; and <br />V <br />COUNTY ATTORN Y,S OFFICE <br />INDIAN poly"It c:OUNrY <br />18 r0 25 h &front <br />Voro 6eachi Florida 32960 <br />O <br />00 <br />W <br />a <br />CM <br />C>t <br />CD <br />
