Board of County Commissioners Meeting Minutes - Final August 14, 2018 <br />Aye: 5- Chairman O'Bryan, Vice Chairman Solari, Commissioner Adams, Commissioner <br />Flescher, and Commissioner Zorc <br />13.D. 18-2163 Florida Public Service Commission Hearing <br />Recommended Action: The County Attorney's Office recommends that the Board vote to approve the filing <br />to intervene in the matter and authorize the County Attorney's Office to work with <br />outside counsel Floyd Self throughout the process. <br />Attachments: Staff Report <br />PSC Order Establishing Procedure <br />County Attorney Dylan Reingold recalled the Florida Public Service Commission's <br />approval on July 2, 2018 to authorize Florida Power & Light (FPL) to charge FPL <br />rates to City of Vero Beach (COVB) utility customers. Subsequently, four <br />petitions were filed challenging that action, and the PSC nullified its order and set a <br />de novo hearing for October 9 and October 10, 2018. Attorney Reingold <br />recommended that the Board authorize filing the necessary paperwork to intervene <br />in the matter. He also recommended that the Board cancel the October 9 BCC <br />meeting so that Commissioners and staff can attend the PSC meeting without <br />conflict. <br />A motion was made by Commissioner Zorc, seconded by Commissioner Adams, to: <br />(1) approve the filing to intervene in the matter and authorize the County Attorney's <br />Office to work with outside counsel Floyd Self throughout the process; and (2) to <br />cancel the October 9, 2018 Board of County Commission meeting, to allow the <br />County Attorney, Commissioners, and staff to attend the Florida Public Service <br />Commission hearing on October 9, 2018 and October 10, 2018.
