Board of County Commissioners Meeting Minutes - Final September 11, 2018 <br />County Attorney Dylan Reingold provided details involving the City of Fellsmere's <br />conflict resolution with the Sebastian River Improvement District with regard to the <br />County's responsibility if they would choose to participate. Attorney Reingold was <br />not in favor of the County formally intervening; however, he recommended that his <br />office would monitor and attend the various meetings between the two entities. <br />Jason Nunemaker, City Manager, City of Fellsmere, 22 South Orange Street, was <br />present to provided background and invite the County to participate in the conflict <br />resolution process. <br />Attorney Edward de la Parte, Jr., representing the Corrigan Family, an interested <br />party, also requested the County's participation as a primary party. <br />A detailed discussion ensued amongst the Board with Commissioner Adams and <br />Commissioner Zorc supporting the County's formal participation in the conflict <br />resolution process. Vice Chairman Solari supported staffs recommendation. <br />Following a request for the County Attorney to further elaborate on his <br />apprehension, Commissioner Flescher was also in support of staffs <br />recommendation that the County not formally intervene. <br />Additional comments for clarification were heard from Commissioner Adams, <br />Commissioner Zorc, the County Attorney, County Administrator Jason Brown, <br />Public Works Director Rich Szpyrka, and Fellsmere's City Manager. <br />A motion was made by Commissioner Adams, seconded by Commissioner Zorc, to <br />become a primary conflicting governmental entity, joining the City of Fellsmere in the <br />conflict resolution process with the Sebastian River Improvement District. The <br />motion failed by the following vote: <br />Aye: 2 - Commissioner Adams, and Commissioner Zorc <br />Nay: 2 - Vice Chairman Solari, and Commissioner Flescher <br />Absent: 1 - Chairman O'Bryan <br />14. COMMISSIONERS MATTERS <br />A. Commissioner Peter D. O'Bryan. Chairman <br />14.A.1. 18-2219 Request the Board consider adopting a Resolution similar to the Resolution <br />adopted by the Treasure Coast Regional Planning Council addressing biosolids <br />and biosolids applications <br />Recommended Action: Commissioner O'Bryan requests the Board to review the Resolution and back <br />up material and then consider adopting a Resolution in support of the TCRPC <br />Resolution. <br />Indian River County Florida Page 23 <br />
