DeBlois, AICP <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Buck <br />Code Enforcement Officer <br />DATE: September 25, 2018 <br />RE: David Middleton and Jennifer Saraceni's Request for Release of Easements at 1005 <br />Clipper Road (Castaway Cove) <br />It is requested that the Board of County Commissioners formally consider the following information at its <br />regular meeting of October 2, 2018. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by David Middleton and Jennifer Saraceni, owners of a lot at 1005 <br />Clipper Road in Castaway Cove subdivision, for release of a 5 foot portion of a 10 foot planting easement <br />and a 10 foot utility easement in the rear yard of the lot. The purpose of the easement release request is to <br />clear title for an existing pool and deck constructed in 1981 within the easements (see attached maps). In <br />researching the pool permit, staff has determined that the pool and deck are legal nonconformities, <br />constructed prior to county form board survey requirements. <br />I-XIE-IJA f.`IR <br />The request has been reviewed by AT&T; Comcast Cable Services; the County Road & Bridge and <br />Engineering Divisions; City of Vero Beach Electric, City of Vero Beach Water and Sewer, and the <br />County Surveyor. None of the utility providers or reviewing agencies expressed an objection to the <br />requested release of. easement. Therefore, it is staff's position that the requested easement release would <br />have no adverse impact to drainage or to utilities being supplied to the subject property or to other <br />properties. <br />RECOMMENDATION <br />Staff recommends that the Board, through adoption of the attached resolution, approve release of the rear <br />yard planting easement portion and utility easement described in the attached resolution. <br />93 <br />
