CONSENT AGENDA <br />INDIAN RIVER COUNTY u k <br />INTER -OFFICE MEMORANDUM <br />OFFICE OF MANAGEMENT AND BUDGET <br />TO: Members of the <br />Board of County Commissioners <br />DATE: November 14, 2018 <br />SUBJECT: Indian River County Subaward and Grant Agreement for Hurricane Irma <br />FROM: Kristin Daniels <br />Director, Management & Budget <br />BACKGROUND: <br />On September 10th 2017, Hurricane Irma made landfall in Florida and impacted Indian River <br />County causing approximately $8 million in expenditures. <br />In order to receive Federal Emergency Management Agency (FEMA) reimbursement, Indian <br />River County is required to sign the Federally -Funded Subaward and Grant Agreement. The <br />agreement is standard for all recipients and includes eleven attachments. After reviewing the <br />agreement, Indian River County has requested an amendment pertaining to sections regarding <br />the Buy America Act, the Copeland Anti -Kickback clause, and the Florida Department of <br />Emergency Management's (FDEM) procurement review. Because the County is a non-federal <br />entity, it is not required to adhere to either the Buy America Act or the Copeland Anti=Kickback <br />clause, and thus the amendment removes those requirements. The amendment also amends the <br />language regarding FDEM' S requirement to review contracts for work performed prior to <br />execution, as the County has already entered into numerous contracts at this time. The <br />requirement does however still apply to any contracts the County may enter into in the future. <br />Upon execution of the agreement and subsequent award of funds, the County will be required to <br />complete contract modifications for each individual project prior to funds being disbursed. <br />These contract modifications essentially revise the total amount of federal funding as each <br />project is awarded. <br />STAFF RECOMMENDATION: <br />Staff recommends the Board approve and authorize the Chairman to execute the agreement and <br />all other documents necessary to effectuate the agreement and authorize the County <br />Administrator to sign any additional modifications. <br />ATTACHMENTS: <br />Federally -Funded Subaward and Grant Agreement <br />Addendum to Federally -Funded Subaward and Grant Agreement <br />218 <br />
