2018 FLORIDA STATUTES Chapter 617 <br />CORPORATIONS NOT FOR PROFIT <br />CHAPTER 455 <br />BUSINESS AND PROFESSIONAL REGULATION: GENERAL PROVISIONS <br />455.01 Definitions.—As used in this chapter, the term: <br />(6) "Profession" means any activity, occupation, profession, or vocation <br />regulated by the department in the Divisions of Certified Public Accounting, <br />Professions, Real Estate, and Regulation. <br />455.227 Grounds for discipline; penalties; enforcement.— <br />* (1) The following acts shall constitute grounds for which the disciplinary <br />actions specified in subsection <br />• (2) may be taken: (a) Making misleading, deceptive, or fraudulent <br />representations in or related to the practice of the licensee's profession. <br />• (b) Intentionally violating any rule adopted by the board or the <br />department, as appropriate. <br />(i) Failing to report to the department any person who the licensee <br />knows is in violation of this chapter, the chapter regulating the <br />alleged violator, or the rules of the department or the board. <br />• (m) Making deceptive, untrue, or fraudulent representations in or <br />related to the practice of a profession or employing a trick or scheme in <br />or related to the practice of a profession. <br />2018 FLORIDA STATUTES <br />CHAPTER 720 HOMEOWNER'S ASSOCIATIONS <br />• 720.301 Definitions.—As used in this chapter, the term: <br />• (1) "Assessment" or "amenity fee" means a sum or sums of money payable to the <br />association, to the developer or other owner of common areas, or to recreational <br />facilities and other properties serving the parcels by the owners of one or more parcels <br />as authorized in the governing documents, which if not paid by the owner of a parcel, <br />can result in a lien against the parcel. <br />• (9) "Homeowners' association" or "association" means a Florida corporation responsible <br />ffor the operation of a community or a mobile home subdivision in which the voting <br />membership is made up of parcel owners or their agents, or a combination thereof, and <br />in which membership is a mandatory condition of parcel ownership, and which is <br />authorized to impose assessments that, if unpaid, may become a lien on the parcel. The <br />term "homeowners' association" does not include a community development district or <br />other similar special taxing district created pursuant to statute. <br />• (10) "Member" means a member of an association, and may <br />inc�but is not limited to. a Darcel owner or an association <br />12/14/2018 <br />
