Board of County Commissioners Meeting Minutes - Final November 20, 2018 <br />1. COUNTY ATTORNEY MATTERS <br />4.A. 18-2532 Martin County, Indian River County, and CARE -FL Brightline Settlement <br />Recommended Action: The County Attorney's Office recommends that Indian River County Board of <br />County Commissioners consider the framework of a settlement agreement. If the <br />Board wishes to enter into a settlement agreement, the County Attorney's Office <br />recommends that the Board adopt a resolution approving the settlement agreement <br />and authorize the chair to execute the settlement agreement and any and all <br />documents necessary to effectuate the settlement agreement, after review and <br />approval by the County Attorney. <br />Attachments: Staff Report <br />Draft Settlement Aareement <br />Draft Settlement Agreement Exhibits <br />County Attorney Dylan Reingold opened the special session by reading the staff <br />report which summarized the County's efforts to oppose the Brightline high-speed <br />rail project; he went on to lay out the benefits and concessions of the proposed <br />Martin County, Indian River County, and CARE -FL Brightline settlement <br />agreement. Both he and Chairman Solari thanked everyone involved in the fight <br />against Brightline, also known as All Aboard Florida and Virgin Trains USA. <br />Chairman Solari opened the discussion with a prepared statement outlining key <br />issues in the County's opposition to high speed rail including: the weakness of <br />Brightline's financials, the diminished value of its brand, their poor safety record, <br />the absence of safety regulations from the Florida Department of Transportation <br />(FDOT), and the limitations to litigation imposed by the settlement agreement. <br />The Chairman was in favor of retaining the right to oppose the project's planned <br />expansion to the Treasure Coast. <br />Indian River County Florida Page 1 <br />
