RESOLUTION NO. 2019 - _ 013 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />APPROVING A HIGHWAY MAINTENANCE MEMORANDUM <br />OF AGREEMENT WITH THE FLORIDA DEPARTMENT OF <br />TRANSPORTATION FOR THE COUNTY ROAD 609/82 ND <br />AVENUE IMPROVEMENT PROJECT FROM 26TH STREET TO <br />69TH STREET AND AUTHORIZING THE CHAIRMAN TO <br />EXECUTE THE AGREEMENT. <br />WHEREAS, the State of Florida Department of Transportation (Department) proposes to <br />construct and improve County Road 609/82 n' Avenue from 26th Street to 691h Street, FM No. <br />230879-3-52-10, Section 88503500, (Project) in Indian River County, Florida; and <br />WHEREAS, upon acquisition of the needed right-of-way, the Department will proceed to <br />construct the Project; and <br />WHEREAS, Indian River County (County) will continue to maintain the existing County <br />owned roadway and right-of-way until the Department begins construction of the Project and the <br />County will continue to be responsible for mowing and litter removal during construction of the <br />Project; and <br />WHEREAS, following the final acceptance of the Project, the County shall be responsible <br />for maintenance of the Project at its own cost and in accordance with Department standards; and <br />WHEREAS, the County, having duly considered the Highway Maintenance <br />Memorandum Agreement, <br />NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br />Indian River County, Florida, that the Highway Maintenance Memorandum Agreement for County <br />Road 609/82nd Avenue from 26th Street to 69th Street is hereby approved and the Chairman is <br />authorized to execute the Agreement on behalf of the Board. <br />BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded <br />forthwith to the State of Florida Department of Transportation at 3400 W. Commercial Boulevard, <br />Ft. Lauderdale, Florida 33309. <br />
