RESOLUTION N0. 85- 58 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />CCI4ISSIONER.S OF INDIAN RIVER COUNTY, <br />0 17JORIDA, PROVIDING FOR CERTAIN PAVING <br />AND DRAINAGE IMPROVEMENT TO 19TH AVENUE <br />SOUTHWEST BETWEEN 13TH AND 14TH STEMS <br />SOUPHWE5T; PROVIDING THE TOTAL ESTIMATED <br />0 COST, MET1= OF PAYMENT OF PSSES&' NPS, <br />NUMBER OF ANNUAL INSTALLMENTS, AND LEGAL <br />DESCRIPTION OF THE AREA SPDCIALLY BR'ITED. <br />WHEREAS, the County Public Works Department has received <br />a public improvement petition, signed by more than a majority (but less <br />than 2/3) of the owners of property in the area to be specially bene- <br />fited, requesting paving and drainage improvements to 19th Avenue <br />Southwest between 13th and 14th Streets Southwest; and <br />WHEREAS, at the July 11, 1984 County Co viission meeting, <br />the Board unanimously moved to initiate the requested inprovements, <br />using the authority reserved to the Board in Section 25 of Ordinance <br />81-27, and authorized the Public Works Division to proceed with the <br />project in accordance with the ordinance; and the design work including <br />cost estimates have been completed by the P blic Works Division and the <br />total estimated cost of the proposed improvements is $16,340.41; and <br />WHEREAS, this resolution has been published in accordance <br />with ordinance requirements, and a public hearing conducted; and <br />WHEREAS, the special assessment provided hereunder shall, <br />for any given record owner of property within the area specially bene- <br />fited, be in an amount equal to that proportion of seventy-five percent <br />(758) of the total cost of the project which the nunber of lineal feet <br />of road frontage owned by the given owner bears to the total number of <br />lineal feet of road frontage within the area specially benefited, and <br />shall becam due and payable at the Office of the 'Pax Collector of <br />Indian River County ninety (90) days after the final determination of <br />the special assessment pursuant to Ordinance 81-27; and <br />WHEREAS, Indian River County shall pay the remaining <br />twenty-five percent(258) of the total cost of the project; and <br />WFlEREAS, any special assessment not paid within said <br />ninety (90) day period shall bear interest beyond the due date at a rate <br />established by the Board of County Ccnu ssioners at the time of prepar- <br />ation of the final assessment roll, and shall be payable in two (2) <br />equal installments, the first to be made twelve (12) months from the <br />due date and the second to be made twenty-four(24) months from the due <br />date; and <br />WHEREAS, after examination of the nature and anticipated <br />usage of the proposed improvements, the Board of County Commissioners <br />has determined that the following described properties shall receive a <br />direct and special benefit from these inprovements, to wit: <br />Lots 12 through 20, Black A; Lot 22, Block A <br />Lots 1, Block D; Lots 3 through 11, Block D; <br />Oslo Park Subdivision as recorded in Plat <br />Book 4 Page 19 in the Public Records of <br />Indian River County, Florida <br />
