,p <br />Providing (First Reso.) ter/sisinf r. w.,/v.. r..t r..,v). w/1r[! <br />RESOLUTION NO. 95- 1 3 5 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, PROVIDING FOR CERTAIN PAVING AND <br />DRAINAGE IMPROVEMENTS TO VERO TROPICAL <br />GARDENS SUBDIVISION AND A PORTION OF <br />PARADISE PARK SUBDIVISION UNIT #3; <br />PROVIDING THE TOTAL ESTIMATED COST, <br />METHOD OF PAYMENT OF ASSESSMENTS, NUMBER <br />OF ANNUAL INSTALLMENTS, AND LEGAL <br />DESCRIPTION OF THE AREA SPECIFICALLY <br />SERVED. <br />WHEREAS, the Indian River County Public Works Department has <br />been petitioned for road paving and drainage improvements for Vero <br />Tropical Gardens Subdivision and a portion of Paradise Park Subdivision <br />Unit #3; and <br />WHEREAS, the construction of paving and drainage roadway <br />improvements by special assessment funding is authorized by Chapter <br />206, Sections 206.01 through 206.09, Indian River County Code and by <br />the Public Works Department and the total estimated assessment cost of <br />the proposed paving and drainage improvements is $1,502,423 or $0.38 <br />per square foot; and <br />WHEREAS, the special assessment provided hereunder shall, for <br />any given record owner of property within the area specially benefited, <br />be in an amount equal to that proportion of 100% of the total cost of the <br />project including Tax Collector's fees, which the number of square feet <br />owned by the given owners bears to the total number of square feet of <br />property specially benefited; and <br />WHEREAS, the special assessment shall become due and payable at <br />the Office of the Tax Collector of Indian River County 90 days after <br />the final determination of the special assessment, pursuant to Section <br />206.08, Indian River County Code; and <br />WHEREAS, any special assessment not paid within said 90 -day <br />period shall bear interest beyond the due date at a rate established by <br />the Board of County Commissioners at the time of preparation of the <br />final assessment roll, and shall be payable in two equal installments, <br />the first to be made 12 months from the due date and subsequent <br />payments to be due yearly; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: <br />A <br />!1 <br />
