DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Bill DeBraal — Deputy County Attorney <br />DATE: February 12, 2019 <br />SUBJECT: Resolution Cancelling Taxes on Lands Containing Guywires Reconveyed <br />to Indian River County by Datapath Tower, LLC <br />In 2016, the former Emergency Services tower site (next to the old jail property at 1725 <br />17th Street) was surplused and sold to Datapath Tower, LLC (Datapath). In the fall of <br />2018, Datapath obtained various easements from Indian River County (County) in <br />connection with its plans to construct a new monopole tower on the site, and reconveyed <br />the lands where the tower guywires are located on, since those lands were no longer <br />needed by Datapath. Once the guywires are removed, it is the County's intention, as soon <br />as practicable, to include the respective lands into the existing 99 -year leases the County <br />has with St. Francis Manor of Vero Beach, Florida, Inc. and Boys & Girls Club of Indian <br />River County, Inc. <br />A resolution is presented for the purpose of earmarking the public use of the property and <br />cancelling any delinquent or current taxes which may exist on the property. <br />FUNDING: <br />There is no cost associated with this item. <br />RECOMMENDATION: <br />Authorize the Chairman of the Board of County Commissioners to execute the <br />Resolution to cancel certain taxes upon the lands reconveyed by Datapath Tower, LLC to <br />Indian River County which currently contain guywires; and the Clerk to send a certified <br />copy of the Resolution to the Tax Collector and the Property Appraiser so that any <br />delinquent or current taxes can be cancelled. <br />/nhm <br />Attachments: Resolution <br />Attachment to Resolution <br />cc: Carole Jean Jordan - Tax Collector <br />Wesley Davis - Property Appraiser 12 <br />
