ANALYSIS: <br />All required improvements necessary to provide access and services <br />to the beach club tract have been constructed, with the exception <br />of a 5' wide public sidewalk along the prof-ect's S.R. A -1-A <br />frontage. Pursuant to LDR provisions, the applicant is "bonding - <br />out" for the required sidewalk. The Public Works Department has <br />approved the amount of the escrowed funds and the County Attorney's <br />office has approved the construction contract and cash escrow <br />agreement forms. The required improvements necessary to serve the <br />beach club building within the tract will be provided by the <br />developer prior to obtaining a certificate of occupancy for the <br />building. All of the required improvements within the development <br />are private, except utilities, which will be dedicated and <br />warranted separately. Since the provision of required internal <br />improvements will be controlled through the PRD site plan process, <br />and since the required improvements necessary to provide service to <br />the tract have been constructed, the developer has complied with <br />the necessary requirements to obtain final plat approval for the <br />boundary plat. <br />RECOMMENDATION: <br />Staff recommends that the Hoard of County Commissioners grant final <br />plat approval for Windsor Plat 8 and authorize the Chairman to sign <br />the construction contract and cash escrow agreement. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Adams, the Board unanimously (4- <br />0, Commissioner Eggert absent) granted final <br />plat approval for Windsor Plat 8 and <br />authorized the Chairman to sign the <br />construction contract and cash escrow <br />agreement, as recommended by staff in the <br />memorandum. <br />COPIES OF CONTRACT FOR CONSTRUCTION OF <br />REQUIRED SIDEWALK IMPROVEMENTS <br />AND CASH DEPOSIT AND ESCROW AGREEMENT <br />ARE ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />N. <br />December 13, 1994 <br />� r � <br />
