40 <br />-9y <br />nRIGINAL <br />AMENDMENT TO AGREEMENT <br />BETWEEN INDIAN RIVER COUNTY <br />AND FIRST BAPTIST CHURCH OF <br />VERO BEACH, INC. FOR SHARED <br />PARKING <br />THIS AGREEMENT, entered into this _�Z day of 1999 by and between <br />INDIAN RIVER COUNTY, a political subdivision of the State of F rida (County) and FIRST <br />BAPTIST CHURCH OF VERO BEACH, INC. (Church); <br />.�� WITNESSETH; <br />Whereas, the County and Church entered into an agreement dated April 11, 1989 for <br />shared parking; and <br />Whereas, the Church and County agree that amended terms to the Agreement would <br />be useful: <br />NOW THEREFORE, in consideration of mutual terms, conditions, promised, <br />covenants, and premises hereinafter setforth, the County and Church agree as follows: <br />I Original al Agreement <br />The original Agreement dated May 11, 1989 between the County and Church shall <br />govern any provision not specifically amended herein. <br />II Amendments <br />A. The Agreement, shall have a termination date of April //2009. <br />B. County shall repave the lot, at its cost, within the first five years of this amendment <br />(year end 2004). <br />C. County will add, at its cost, an additional light at the entrance of 16th Avenue <br />within 90 days of the date of this amendment. <br />D. County shall not open the Main Library before 1:00 P.M. on Sunday, and should <br />the hours extend beyond 6:00 p.m., the County shall undertake the necessary action <br />to insure the exclusive use of the subject parking lot by the congregation of the First <br />Baptist Church. <br />E. County and Church hereby agree to grant each other an easement over their portion <br />of the abandoned portion of 22nd Street that provides access to 17th Avenue. Said <br />cross -easements shall be for the purpose of ingress and egress and shall terminate <br />when the amended agreement terminates. <br />III Recordine <br />This lease shall be recorded. <br />
