SECOND EXTENSION TO YARD WASTE PROCESSING AND DISPOSAL SERVICES AGREEMENT BETWEEN <br />INDIAN RIVER COUNTY SOLID WASTE DISPOSAL DISTRICT ("SWDD") AND RUSSELL PAYNE, INC. d/b/a <br />MR. MULCH, INC. ("CONTRACTOR") <br />THIS SECOND EXTENSION to Yard Waste Processing and Disposal Services Agreement is by and between <br />the Indian River County Solid Waste Disposal District, a dependent special district of INDIAN RIVER COUNTY, <br />a Political Subdivision of the State of Florida organized and existing under the Laws of the State of Florida, <br />(hereinafter called SWDD) and Russell Payne, Inc., d/b/a Mr. Mulch, Inc. (hereinafter called CONTRACTOR). <br />SWDD and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree as follows: <br />RECITALS <br />WHEREAS, On March 7, 2017, SWDD and CONTRACTOR entered into the Yard Waste Processing and <br />Disposal Services Agreement (the "Agreement"); and <br />WHEREAS, the initial term of the Agreement was for one year, beginning on April 1, 2017, and allowed <br />for six one year extensions; and <br />WHEREAS, the Indian River County Board of County Commissioners authorized the Purchasing Manager <br />the approval authority to extend the at the same price and conditions at the time of renewal, so long as <br />CONTRACTOR has been performing properly, CONTRACTOR's insurance and bond are up to date, and if <br />the extension would be in the best interest of the County; and <br />WHEREAS, SWDD and CONTRACTOR executed the first extension for the period April 1, 2018 through <br />March 30, 2019; and <br />WHEREAS, the requirements for an extension have been satisfied and, SWDD and CONTRACTOR desire <br />to execute the second extension to the Agreement for the period April 1, 2019 through March 30, 2020. <br />IN WITNESS WHEREOF, SWDD and CONTRACTOR have executed this First Extension this ZIfh day of <br />Ma rc4, , 2019. <br />OWNER: <br />INDIAN RIVER <br />DISTRICT <br />COUNTY SOLID WASTE DIS,.Q$AL <br />*z)oMM1Ss. <br />.��.
