Brown, County Administrator <br />Kristin Daniels, Director, Office of Management and Budget <br />Jennifer Hyde, Purchasing Manager <br />Modification to Purchasing Manual Paragraph 1.3.P Regarding Projects <br />Involving Federal Funding <br />BACKGROUND: <br />The current Purchasing Manual (Policies and Procedures) includes requirements for projects <br />receiving federal funding. The Florida Department of Economic Opportunity Bureau of Small Cities <br />and Rural Communities reviewed these requirements in relation to our Community Development <br />Block Grant Housing funding and is requiring one change to be made to our listed requirements, as <br />shown below, referring to the Code of Federal Regulations ("C.F.R."). <br />P. Projects Involving Federal Funding. When a procurement involves federal assistance or <br />the expenditure of federal funds, the procurement and any resulting contract shall be <br />conducted in accordance with any mandatory applicable federal laws and regulations, including <br />2 C.F.R. §200.317 through 326. Departments are responsible for defining funding sources when <br />requesting a bid number. <br />DISCUSSION: <br />The C.F.R." paragraph to be added by reference is: "§200.317 Procurements by states. When <br />procuring property and services under a Federal award, a state must follow the same policies <br />and procedures it uses for procurements from its non -Federal funds. The state will comply with <br />§200.322 Procurement of recovered materials and ensure that every purchase order or other <br />contract includes any clauses required by section §200.326 Contract provisions. All other non - <br />Federal entities, including subrecipients of a state, will follow §§200.318 General procurement <br />standards through 200.326 Contract provisions." <br />The change was approved by the County Administrator under his authority established in <br />section 105.06, Indian River County Code on February 21, 2019, and will be incorporated into <br />the annual revision to the Manual, anticipated for presentation to the Board in April of 2019. <br />RECOMMENDATION <br />No action is required by the Board. <br />7 <br />
