1/N/B4(fatal) Rzsco n.wbsd/Vk <br />RESOLUTION NO. 94- 34 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, PURSUANT TO SECTION 197.402, <br />FLORIDA STATUTES, CHOOSING A NEWSPAPER IN <br />WHICH LEGAL AND OFFICIAL ADVERTISEMENTS <br />WILL BE PUBLISHED FROM MARCH 1, 1994 <br />THROUGH FEBRUARY 28, 1995. <br />WHEREAS, Section 197.402, Florida Statutes, requires that when legal <br />advertisements are needed the Board of County Commissioners shall select a <br />newspaper as provided in Chapter 50, Florida Statutes; and <br />WHEREAS, Rule 12-D-13.036(1), Florida Administrative Code, implies <br />that this choosing of a newspaper shall be performed annually; and <br />WHEREAS, this Rule directs explicitly that at the first Board meeting in <br />February the Board of County Commissioners shall select the newspaper in <br />which said advertisements shall be placed; and <br />WHEREAS, Section 50.11, Florida Statutes, sets out certain criteria for <br />the publication to be a qualified advertiser for legal and official notices; and <br />WHEREAS, these qualifications include that: <br />1. The newspaper must be printed and published once a week or <br />more often. <br />2. The newspaper must contain at least 25% of its words in the <br />in the English language. <br />3. The newspaper must be admitted and entered as second-class <br />mail at a post office. <br />4. The newspaper must be for sale to the public generally. <br />5. The newspaper must be available to the public generally for <br />the publication of official or other notices and customarily <br />containing information of a public character or of interest or <br />value to the residents or owners of property in the county <br />where published or of interest or value to the general <br />public; and <br />WHEREAS, the Board of County Commissioners after going out <br />for bid determined that it would be in the public interest to select <br />the Press -Journal; <br />
