RESOLUTION NO. 94-37 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA AMENDING RESOLUTION NO. 94-2, THE <br />AMENDED DEVELOPMENT ORDER (D.O.) FOR THE DEVELOPMENT OF <br />REGIONAL IMPACT (DRI) PROJECT FORMERLY KNOWN AS VILLAGE <br />GREEN WEST & VILLAGE GREEN SOUTH, NOW KNOWN AS <br />COUNTRYSIDE NORTH & SOUTH <br />WHEREAS, as provided in Chapter 380 Florida Statutes, on <br />January 4, 1994 the Board of County Commissioners adopted <br />Resolution No. 94-2 which is the amended development order (D.O.) <br />for the development of regional impact (DRi) project formerly known <br />as Village Green West & Village Green South, now known as <br />Countryside North & South; and <br />WHEREAS, the Department of Community Affairs (DCA) has <br />requested minor modifications to Resolution 94-2; and <br />WHEREAS, neither the applicant nor Treasure Coast Regional <br />Planning Council (TCRPC) staff have expressed any objections to the <br />requested minor modifications; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida that Resolution No. <br />94-2 be modified by the addition of the following underlined <br />wording to paragraph 12: <br />12. No building permit shall be issued for development within the <br />overall DRi project after December 31, 2005 unless the project <br />buildout date is extended and a traffic study for the project <br />is conducted by the developer and is approved by Indian River <br />County, Florida Department of Transportation, the Florida <br />Department of Community Affairs, and the Treasure Coast <br />Regional Planning Council. The Study shall identify the <br />improvements and timing of those improvements necessary to <br />maintain adopted levels of service on the impacted <br />transportation network, and shall propose an improvements <br />program that is acceptable to Indian River County, Florida <br />Department of Transportation, Florida Department of Community <br />Affairs, and the Treasure Coast Regional Planning Council. <br />The foregoing resolution was offered by Commissioners <br />Macht and the motion was seconded by Commissioner <br />Euuert , and, upon being put to a vote, the vote was as <br />follows: <br />Chairman John W.
