Board of County Commissioners <br />Meeting Minutes - Final March 5, 2019 <br />A motion was made by Commissioner O'Bryan, seconded by Commissioner Zorc, <br />to adopt Ordinance 2019-008, amending the Future Land Use Map by changing <br />the land use designation for ±11.59 acres located at the southeast corner of 79th <br />Street and U.S. Highway 1 from CII, Commercial Industrial to M-1, Medium <br />Density Residential -1 (up to 8 units per acre); and to simultaneously redesignate <br />±11.44 acres located at the northeast corner of 41st Street and U.S. Highway 1 <br />from M-1, Medium Density Residential -1 (up to 8 units per acre), to CII, <br />Commercial Industrial; and providing codification, severability, and effective <br />date. The motion carried by the following vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />O'Bryan, and Commissioner Zorc <br />Chairman Solari proceeded to the second hearing, a request to rezone both <br />properties. The Chairman introduced the parties for the proceeding as being <br />Indian River Land Trust, Inc. and Schwerin Asset Advisors, LLC. <br />Each Commissioner, as requested by the Chairman, disclosed ex parte <br />communications, site visits, or independent investigations. The Commissioners <br />also affirmed that they have an open mind and can base their decisions on the <br />evidence presented and the applicable law. The Chairman confirmed that any <br />and all documents and all tangible evidence had been submitted to the Clerk. <br />Senior Planner Bill Schutt displayed staffs recommendation from the <br />previously shown PowerPoint presentation. <br />Chairman Solari opened the Public Hearing. There being no speakers, the <br />Chairman closed the public hearing. <br />A motion was made by Commissioner Flescher, seconded by Commissioner <br />Zorc, to adopt Ordinance 2019-009, amending the Zoning Ordinance and Zoning <br />Map for ±11.59 acres located at the southeast corner of 79th Street and U.S. <br />Highway 1 from CL, Limited Commercial District, to RM -6, Multi -family Residential <br />District (up to 6 units per acre); and to simultaneously change the zoning <br />designation of ±10.61 acres located at the northeast corner of 41st Street and <br />U.S. Highway 1 from RM -6, Multi -family Residential District (up to 6 units per <br />acre), to CL, Limited Commercial District and to change the zoning designation of <br />±0.83 acres located adjacent to the northwest corner of that property from RM -6, <br />Multi -family Residential District (up to 6 units per acre), to OCR, Office, <br />Commercial, Residential District; and providing codification, severability, and <br />effective date.
