RESOLUTION NO. 2019 - <br />A <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, RELEASING <br />A PORTION OF AN EASEMENT RESERVED OVER ABANDONED SHORT <br />STREET RIGHT-OF-WAY ABUTTING BLOCK 52A, TOWN OF WAUREGAN <br />SUBDIVISION, AND CORRECTING THE LEGAL DESCRIPTION OF SHORT <br />STREET RIGHT-OF-WAY ABANDONED PER COUNTY RESOLUTION 2003-148 <br />WHEREAS, Indian River County has an interest in a drainage and utility easement reserved over an <br />abandoned portion of Short Street right-of-way abutting Block 52A, Town of Wauregan Subdivision; and <br />WHEREAS, Adrienne Mari Dissis, the owner of the property, has made application to Indian River <br />County requesting that the County release a portion of the easement; and <br />WHEREAS, the retention of the easement portion, as described below, serves no public purpose; and <br />WHEREAS, it has been determined by the County Surveyor that the legal description of abandoned <br />Short Street right-of-way contained in Indian River County Resolution 2003-148 erroneously described <br />the abandoned right-of-way as 50 feet wide when in fact it is 70 feet wide; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River <br />County, Florida that: <br />INDIAN RIVER COUNTY DOES HEREBY RELEASE and abandon all right, title, and interest <br />that it may have in the following described easement portion: <br />the southwesterly five (5) feet of the northwesterly twenty five (25) feet of a drainage & utility easement <br />reserved over abandoned Short Street right-of-way abutting Block 52A, Town of Wauregan Subdivision, per Indian <br />River County Resolution 2003-148 recorded in O.R. Book 1685, Page 558, Public Records of Indian River County. <br />FURTHERMORE, INDIAN RIVER COUNTY HEREBY AMENDS AND CORRECTS the legal <br />description of abandoned right-of-way contained in County Resolution 2003-148, as recorded in O.R. <br />Book 1685, Page 558, Public Records of Indian River County, as follows: <br />all that portion of Short Street lying between the southwesterly right-of-way line of 134th Street (Brevard Ave.) <br />and the northeasterly right-of-way line of the Florida East Coast Railway, Town of Wauregan Subdivision, recorded <br />in Plat Book 1, Page 75, Public Records of Brevard County, Florida, refiled in Plat Book 1, Pages 178 and 179, <br />Public Records of St. Lucie County, Florida, now lying and being in Indian River County, Florida. <br />This release of easement and legal description correction of County Resolution 2003-148 is executed <br />by Indian River County, a political subdivision of the State of Florida, whose mailing address is 1801 <br />27th Street, Vero Beach, Florida 32960. <br />THIS RESOLUTION was moved for adoption by Commissioner , seconded by <br />Commissioner , and adopted on the day of , 2019, <br />by the following vote: <br />Chairman Bob Solari <br />Vice -Chairman Susan Adams <br />Commissioner Joseph E.
