3120190024950 • <br /> RECORDED IN THE PUBLIC RECORDS OF <br /> JEFFREY R SMITH, CLERK OF COURT <br /> INDIAN RIVER COUNTY FL <br /> RESOLUTION NO.2019-032 BK: 3202 PG: 1752 Page 1 of,2 4/29/2019 1:40 PM <br /> A RESOLUTION OF INDIAN RIVER COUNTY,FLORIDA,RELEASING <br /> A PORTION OF AN EASEMENT ON LOT 38, CITRUS SPRINGS VILLAGE "A" PD <br /> PHASE II <br /> WHEREAS, Indian River County has an interest in a 25-foot wide rear yard landscape easement on <br /> Lot 38 of Citrus Springs Village "A" PD Phase II; and <br /> WHEREAS,Ronald R. Brooks and Susan K. Brooks, the owners of the lot, have made application to <br /> Indian River County requesting that the County release a 10-foot portion of the easement; and <br /> WHEREAS, the owners have agreed to satisfy county landscape requirements within the remaining <br /> 15-foot width of the easement not proposed for release, and to meet county building setback <br /> requirements for a proposed screen enclosure to be constructed within the 10-foot easement portion <br /> proposed for release; and <br /> WHEREAS,based on those agreed to conditions,the retention of the 10-foot portion of the easement, <br /> as described below, serves no public purpose; <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River <br /> County,Florida that: <br /> INDIAN RIVER COUNTY DOES HEREBY RELEASE and abandon all right,title, and interest <br /> that it may have in the following described easement portion: <br /> the south ten(10)feet of the north twenty-five(25)foot rear yard Type "C"Buffer Landscape Easement of <br /> Lot 38, Citrus Springs Village "A"P.D. Phase II, according to the replat thereof as recorded in Plat Book 18, Page <br /> 10 of the Public Records of Indian River County, Florida. <br /> This partial release of easement is executed by Indian River County, a political subdivision of the <br /> State of Florida,whose mailing address is 1801 27th Street,Vero Beach,Florida 32960. <br /> THIS RESOLUTION was moved for adoption by Commissioner Flescher , seconded by <br /> Commissioner Zorc , and adopted on the 23 day of April ,2019, <br /> by the following vote: <br /> Chairman Bob Solari AYE <br /> Vice-Chairman Susan Adams AYE <br /> Commissioner Joseph E.
