rnaaa zz-.aupplemental <br />lei 1 } <br />3 <br />RESOLUTION NO. 94- 98 <br />IN T(''_` 'ivr;()qr)S OF <br />LEBARTON URCRKCIRCO C T <br />INDIAN RIVER CO., FLA: <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, <br />ASSESSING, APPROVING, AND CONFIRMING CERTAIN <br />SUPPLEMENTAL SPECIAL ASSESSMENTS IN CONNECTION WITH <br />WATER SERVICE IN THE PHASE III WATER MAIN EXTENSION <br />GROWTH PLAN. <br />-- WHEREAS, the Board of County Commissioners of Indian River County <br />determined that water improvements for properties located within the <br />area of the Phase III Water Main Extension Growth Plan are necessary to <br />promote the public welfare of the county; and <br />l WHEREAS, on Tuesday, June 22, 1993, the Board held a public hearing <br />at which time and place the owners of property to be assessed appeared <br />before the Board to be heard as to the propriety and advisability of <br />t " <br />making such improvements; and <br />WHEREAS, after such public hearing was held the County Commission <br />adopted Resolution No. 93-108A, which confirmed the special assessment <br />Ile <br />cost of the project to the property specially benefited by the project <br />in the amounts listed in the attachment to that resolution; and <br />h WHEREAS, the Director of Utility Services has determined it is <br />desirable to assess, approve, and confirm certain supplemental special <br />assessments against certain properties shown on attached Exhibit "A" and <br />V <br />the owners of which have consented thereto; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, as follows: <br />1. The supplemental special assessments shown on attached Exhibit "A" <br />are hereby assessed, approved, and confirmed and shall remain <br />legal, valid, and binding first liens against the properties <br />assessed until paid in full. <br />2. The Clerk is hereby directed to record the supplement special <br />assessments shown on attached Exhibit "A" in the public records of <br />Indian River County, Florida, which shall constitute prima facie <br />evidence of the validity .of the lien of the supplement special <br />assessments. <br />3. The supplement special assessments shall have the same terms and <br />conditions as the special assessment, including without limitation <br />terms of payment, rate of interest, penalties, terms of prepayment, <br />manner of collection, and priority of lien. <br />
