t1 # <br />INTHERECORDSOF <br />CLEFOIRCUrrCOURf <br />RESOLUTION NO. 94-ja (WDIA RIVERCO.,FLA. <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, VACATING, IN PART, THE PLAT <br />OF SANDPOINTE WEST SUBDIVISION, AS RECORDED IN PLAT BOOK <br />13, PAGES 31 AND 31A, PUBLIC RECORDS OF INDIAN RIVER <br />COUNTY, FLORIDA. <br />WHEREAS, the plat of Sandpointe West has been filed in Plat <br />Book 13, Page 31 and 31A, Public Records of Indian River County, <br />Florida; and <br />WHEREAS, Sandpointe West Development, L.C., the fee simple <br />owner of a portion of the Sandpointe West subdivision has applied <br />for vacation of a portion of said plat, returning.that portion to <br />acreage; and <br />WHEREAS, the portion of the plat to be vacated consists of all <br />of Lots 1-12 Sandpointe West and the east 3 of Lot 13 as recorded <br />in Plat Book 13, Pages 31 and 31A, Public Records of Indian River <br />County, Florida; and <br />WHEREAS, it has been shown that the vacation will not affect <br />the ownership or right of convenient access of persons owning other <br />parts of the development; and <br />WHEREAS, notice of the intention to apply to the Board of <br />County Commissioners of Indian River to vacate a portion of such <br />plat has been published as a legal notice in a newspaper of general <br />circulation in Indian River County in not less than two weekly <br />issues of said paper; and <br />WHEREAS, proof of said publication of petition for vacation is <br />attached hereto; and <br />WHEREAS, certificates from the Tax Collector showing that all <br />state and county taxes have been paid on the property are attached <br />hereto, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida, that: <br />1. All the above recitals are true and affirmed. <br />2.
