DESIGNATION OF SHERIFF AS CHIEF CORRECTIONAL OFFICER <br />The Board reviewed a Memorandum of December 22, 1994: <br />TO: Board of County Commissioners <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: December 22, 1994 <br />RE: Designation of Sheriff an Chief Correctional Officer <br />In Indian River County the Sheriff <br />has operated the County jail <br />since <br />the creation of the County in 1925, <br />except between 1984 and 1986 <br />when <br />the Board of <br />County Commissioners <br />did. The Board transferred <br />this <br />responsibility <br />back to the Sheriff <br />in 1986 by voice vote after the <br />County found <br />it impossible to get adequate insurance coverage. <br />Insurance was <br />available through the <br />Florida Sheriffs' Association <br />only <br />to Sheriffs. <br />_ <br />Since the transfer back to the Sheriff, Florida law has been amended to <br />require that the County Commissioners choose a "Chief Correctional <br />Officer." The law allows a majority of the County Commission to pick <br />the Sheriff as this officer. <br />It is necessary for the Board of County Commissioners to adopt an <br />ordinance appointing a Chief Correctional Officer. The attached <br />ordinance appoints the Sheriff as the Chief Correctional officer; <br />however, the Board does have the authority to appoint someone else or to <br />undertake the responsibility itself. <br />Requested Action: Request permission to advertise the attached <br />ordinance choosing the Sheriff as the Chief Correctional Officer. A <br />hearing date of January 24, 1995, is recommended. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously <br />approved the advertisement of a proposed ordinance <br />choosing the Sheriff as Chief Correctional Officer, <br />with the public hearing to be held January 24, 1995, <br />as recommended by staff. <br />SOLID WASTE FLOW CONTROL <br />The Board reviewed a Memorandum of December 27, 1994: <br />JANUARY 3, 1995 33 BOOK �4 FAIL. 3 <br />
